1. Acceptance of terms
By accessing or using SuperMem GrowthOS (the "Service"), provided by Super Intelligence Inc. ("we", "us", "our"), you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. The service
SuperMem GrowthOS is a growth program operating system that combines AI agents, human operators, and a persistent memory layer to plan and execute marketing and growth work on your behalf. The exact modules included depend on the plan you've selected and may evolve over time.
3. Accounts & eligibility
- You must be at least 18 years old and able to enter a binding contract.
- You are responsible for safeguarding your account credentials and for all activity under your account.
- You agree to provide accurate information and keep it up to date.
4. Acceptable use
You agree not to use the Service to:
- Send unlawful, deceptive, harassing, or unsolicited bulk communications.
- Infringe on the intellectual property, privacy, or other rights of any third party.
- Reverse engineer, scrape, or attempt to gain unauthorized access to the Service.
- Upload malware or use the Service to interfere with anyone else's systems.
We may suspend or terminate accounts that violate this section.
5. Subscriptions & billing
- Paid plans are billed monthly unless otherwise stated on your order. Prices are listed on /pricing and may change with reasonable notice.
- Fees are non-refundable except where required by law or expressly stated.
- Free tier features may change or be discontinued at our discretion.
- Taxes (where applicable) are your responsibility.
6. Your content & data
You retain all rights to data and content you upload, generate inside, or otherwise contribute to the Service ("Your Content"). You grant us a limited license to host, process, and operate on Your Content solely to provide the Service to you.
We do not use Your Content to train third-party foundation models. See our Privacy page for details.
7. Our intellectual property
The Service, including the software, design, and documentation, is owned by Super Intelligence Inc. and protected by intellectual property laws. Nothing in these Terms grants you ownership of the Service itself.
8. Confidentiality
Each party agrees to protect the other's confidential information with at least the same care it uses for its own, and to use it only as needed to perform under these Terms.
9. Service availability
We work hard to keep the Service available, but we do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, and unforeseen events can cause downtime. Where we offer SLAs, they are described in your order or plan documentation.
10. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Outputs from AI components may contain errors; you are responsible for reviewing them before relying on them in production.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claims arising out of or related to the Service will not exceed the amounts you paid us in the twelve months preceding the event giving rise to the claim. We will not be liable for indirect, incidental, consequential, or punitive damages.
12. Termination
You can stop using the Service at any time. We can suspend or terminate your access if you breach these Terms or if required by law. Sections that by their nature should survive termination will continue to apply.
13. Changes to these terms
We may update these Terms from time to time. If a change is material we will give reasonable notice (for example, by email or in-product notice). Continued use of the Service after the change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles, unless your order or local mandatory law specifies otherwise.
